In order not to find themselves in a difficult situation when buying a home, Astana residents should thoroughly check the permits for fundraising from the developer. Experts told what exactly should be paid attention to, the official website of the Mayor's Office of Astana reports.
Equity participation in housing construction is organized in one of the following ways:
- obtaining a guarantee from a single housing construction operator;
- participation in the second-tier bank project;
- receiving money from shareholders after the construction of the frame of an apartment building.
It is prohibited to accept money from shareholders for housing construction in other ways through a pre-booking agreement, a reservation agreement, an investment agreement, a contract of assignment of the right of claim.
A list of information on issued permits from the local executive body in the field of equity participation in housing construction can be obtained on the official website of the state institution "Department of Architecture, Urban Planning and Land Relations of Astana city". The register of agreements on the guarantee of facilities under construction of JSC "Kazakhstan Housing Company" is regularly published on the official website of the Akimat of Astana, as well as a list of multi-apartment residential complexes under construction that do not have permission to accept money from shareholders.
Citizens should know a few rules before entering into an agreement on equity participation in housing construction:
- the contract is concluded in writing and is considered concluded from the moment it is registered with the local executive body;
- the acceptance of the money of shareholders is carried out by an authorized company on the basis of the permission of the local executive body;
- the authorized company provides detailed information about the construction site for review by individuals and legal entities who have applied for the purpose of concluding an agreement on equity participation in housing construction;
- if the authorized company provides incomplete and unreliable information, the shareholder has the right to apply to the court with a claim for invalidation of the agreement on equity participation in housing construction.
