The Maslikhat of Almaty has approved new Building Rules, suggesting strict restrictions on construction

In Almaty, during an extraordinary session of the Maslikhat, deputies approved new Rules for the development of the city, developed by the akimat in order to prevent spot construction, development of foothills, green areas and courtyards. Previously, the document was widely discussed with experts and the public.
Speaking to the deputies of the Maslikhat, head of the Department of Urban Planning and Urban Studies Nurlan Buranbayev noted that the new rules imply stricter restrictions on construction and increased control by government agencies regarding the acceptance of multi-apartment residential complexes, as well as expand the functions of architectural and construction control bodies.
What restrictions do the new rules provide?
The number of floors for construction between Abai and al-Farabi Avenues has been fixed: buildings of all types must not exceed 9 floors and 35 meters.
The exception is unique facilities, the construction of which will be allowed only if there is an architectural and urban justification for their social significance, ensuring the sustainability and environmental friendliness of design solutions, including the use of energy-efficient and resource-saving technologies.
The rules also regulate the construction procedure in earthquake-prone areas and in the foothills (mountain "counters") south of VOAD, al-Farabi Avenue, Sain and Zhandosova Streets.
- it is prohibited to build buildings in the strip of mountain counters, including on sites with a slope of 15 degrees or more;
- the previously adopted decision on the height of buildings no higher than 12 meters and 3 floors, except for public and cultural facilities, is consolidated;
- re-equipment of terraces and technical floors during reconstruction is prohibited.
In addition, the requirement for the construction of housing of at least class III is fixed throughout the city with at least 1 parking space per apartment.
Measures to prevent spot construction and preserve recreational areas
The issue of spot placement of buildings in existing residential areas and courtyards is relevant for Almaty. If previously there was no legislative ban on the construction of facilities in green areas and playgrounds in courtyards, then such construction is prohibited in the new rules.
It is also strictly prohibited to build gas stations and service stations on central city highways, near social facilities and facilities of mass visits to the population.
In order to preserve the natural fund and yard recreational areas, a ban is being imposed on changing the natural landscape in order to increase the construction area, fill in foothill ravines, streams, and prune mountain counters.
