In Shymkent, efforts to reclaim land plots used in violation of the law have intensified. One striking example is the situation with the Ken Baba Park, which has become the subject of legal proceedings and public attention.

Ken Baba Park is one of the most famous and beloved recreation areas for residents and visitors to the city. Located in central Shymkent, it was originally conceived as a public space for walks, family leisure, and cultural events. However, in recent years, part of the park's territory has become occupied by commercial properties.

This land plot was previously leased to the limited liability partnership "Almaty-Sapar." According to the agreement, the land was provided for temporary use to establish a center for aesthetic and cultural education for children and adolescents. This goal fully aligned with the city's interests and envisioned a socially significant project.

However, after the lease expired, the company failed to vacate the site and continued to use the land. Furthermore, the actual use of the land was inconsistent with the stated purposes, raising concerns among the public and authorities.

In connection with the violation identified, the city administration filed a lawsuit, demanding that the tenant be compelled to return the site to its original condition.

The case was heard in the specialized inter-district economic court of Shymkent. A legal review of all documents related to the land plot was conducted in response to the claim filed by the city's Department of Land Resources Management.

The court found that the title documents previously issued to Almaty-Sapar LLC had become invalid and could not serve as the basis for further land use. By the court's decision, the title documents for the plot located at 68/1 G. Ilyaev Street, Al-Farabi District, were declared invalid .

Thus, the entrepreneur no longer had any legal basis for owning and exploiting the territory.

After the court decision entered into force, the process of actually returning the land plot to state ownership began.

Today, work is underway to dismantle and demolish illegally erected structures within the Ken Baba Park. Utility specialists and contractors are working within the approved plan to clear the land of permanent and temporary structures as quickly as possible.

The task is not limited to simply clearing the site. It is important to restore the area to its original appearance so that it can once again fulfill its public purpose – serving as part of the city's recreational zone.

The situation around Ken Baba Park clearly demonstrates the pressing need to preserve public lands. Every hectare of urban land is a resource that must be used in the public interest. Illegal occupation or commercial exploitation of land deprives residents of their right to access public spaces.

The return of the site to state ownership not only restores justice but also takes a step toward developing an ecologically sustainable urban environment. Once vacated, Ken Baba Park will become an even more attractive destination for recreation, sports, and cultural events.

Efforts to identify and rectify land use violations are carried out systematically. The Department of Land Resources Management, in conjunction with the city administration, regularly conducts inspections, analyzes lease agreements, and identifies instances of unauthorized land seizures.

To date, dozens of cases have been identified in Shymkent alone where tenants have either exceeded their authority or continued to use land after their leases expired. Legal action is being taken for each such incident, ranging from warnings to legal action.

Authorities emphasize that such actions are not directed against businesses per se, but against violations of the law. Law-abiding entrepreneurs who use land plots for their intended purpose and within the lease terms can be assured that their rights will be protected. However, any attempts to illegally seize or exploit land will be strictly suppressed.

The city administration and the prosecutor's office have repeatedly appealed to residents and businesses to respect the law and take care of public spaces.

Public oversight plays an equally important role here. It is thanks to complaints and the active participation of citizens that violations are identified and addressed promptly.

Every city resident has the right to report instances of illegal construction or improper land use. Such reports are reviewed in accordance with established procedures, and if the allegations are confirmed, appropriate action is taken.

The return of the Ken Baba Park site to state ownership is an important precedent, demonstrating that Shymkent is systematically working to protect public interests.
