In November of this year, the Head of State signed the Law of the Republic of Kazakhstan "On Amendments and Additions to Certain Legislative Acts on intellectual property issues. The law is aimed at strengthening protection in the field of intellectual property. Amendments to the legislative acts of the Republic of Kazakhstan on intellectual property issues:

The main innovation in the field of intellectual property rights protection is the Unified Digital Platform (EDS) in the field of collective rights management. It will allow recording the use of works and the accrual of remuneration in a single system, providing transparency and convenience for both authors and users. The implementation of the platform makes the collection and distribution of rewards fair.

The specified remuneration is distributed by an expert organization among organizations for the collective management of rights in accordance with this Law.

The amount, procedure for collecting, distributing and paying remuneration are established by the authorized body of the Republic of Kazakhstan.

Digitalization will help to increase transparency and efficiency in the field of intellectual property.

In addition, visually impaired persons are given the opportunity to use published works without the author's permission and without paying remuneration.

The term of trademark registration has been reduced to 3 months in an expedited manner.

The deadline for filing objections to trademark registration has been increased from 1 to 2 months.

State control over the use of copyright and related rights has been strengthened.

At the same time, amendments have been made to the Civil Code of the Republic of Kazakhstan (Special Part), the Business Code, the Code "On Customs Regulation in the Republic of Kazakhstan", the Laws "On Copyright and Related Rights", "On the Protection of Breeding Achievements", "Patent Law of the Republic of Kazakhstan", "On Trademarks, service marks, geographical indications and names of the places of origin of goods", "On the legal protection of integrated circuit topologies", "On judicial authorities".

A number of changes, in particular the trademark registration procedure and the digital platform, will be implemented in 2026.
