Land plots located within the city limits of a city of national significance, the capital, and cities of regional and district significance are considered lands of populated areas. They are designated for the construction of housing, commercial facilities, social and engineering infrastructure, and are an important part of urban development.
In accordance with the legislation of the Republic of Kazakhstan, citizens and legal entities may acquire land plots for private ownership or receive them for temporary land use. However, it should be noted that not all land within city limits can be transferred to private ownership. Public lands—roads, streets, parks, squares, and plazas—are not subject to transfer.
Land rights may be acquired in the following ways:
Provision of a state-owned land plot by decision of the akimat;
participation in land auctions (auctions);
purchase of a previously allocated land plot;
acquisition through civil law transactions (purchase and sale, donation, inheritance).
Land plots for the placement of business and commercial facilities are typically allocated through auction. To obtain a land plot, a citizen or legal entity must submit an application to the authorized body. This can be done:
through the Public Service Center (PSC);
through the e-government portal eGov.kz;
directly to the Akimat (depending on the type of service).
The application must specify the intended use of the land plot, its proposed location, and the type of right requested (ownership or land use). The application must be accompanied by documents proving the applicant's identity, as well as other documents required by the rules for providing the public service.
After submitting the application, the feasibility of allocating the land plot is verified, taking into account the city's general plan, detailed planning project, intended use of the land, and urban development requirements. Following the review, the applicant is sent a decision—either to grant or deny the land plot, stating the reasons.
It is important to remember that the land plot may have restrictions and encumbrances related to utility lines, sanitary and security zones, and special conditions for land use. It is recommended to verify this information in advance.
Ownership or land use rights to a land plot arise only after its state registration. Prior to registration, a land plot is not considered registered.
Before applying for a land plot, experts recommend clarifying the legal status of the land, its intended use, and any restrictions in advance by contacting the Akimat or Public Service Center. This will help avoid potential refusals and additional costs.
