Today, at an expanded meeting of the Government of the Republic of Kazakhstan, Head of State Kassym-Jomart Tokayev delivered a closing speech, in which he touched upon the main priorities of the new stage of the country's development and the relevant aspects of the new draft Constitution. According to the President, the core of the proposed constitutional changes is the specific and effective protection of the rights and freedoms of citizens.
The Head of State noted that this position is not an empty declaration. The new draft Constitution provides for the formation of a unified system with clear mechanisms for protecting human rights. As evidence of this, the President noted that a separate article on the legal profession was included in the draft Constitution at the suggestion of the Bar Association. This norm was assessed as an important step towards increasing the level of legal protection of citizens.
In addition, the new Constitution further emphasizes the secular nature of the state by giving priority to the education system. The President also paid special attention to the issue of preserving traditional values in society, noting that the introduction of the phrase "Marriage is a voluntary and equal union of a man and a woman" serves this purpose. In addition, the draft Constitution also pays special attention to the issue of environmental protection.
The President stressed the need to strengthen the most important social norm related to the protection of housing rights. He proposed to supplement the provision on inviolability of housing in the current Constitution with a norm stating that "forcible eviction from a residential building is also not allowed without a court decision." According to the Head of State, this proposal fully corresponds to the social nature of the new Constitution.
Kassym-Jomart Tokayev noted that the new draft Constitution clearly enshrines such basic principles as "A Just Kazakhstan", law and order, and absolute protection of citizens' rights and freedoms. Education, science, innovation, and culture are identified as unrivaled priorities for the country's development. The Constitution also clearly states that independence, sovereignty, and territorial integrity remain inviolable values, and that the unitary nature of the country and the form of government will never change.
The President noted that special attention was paid to strengthening unity and harmony, consolidating the concept of responsible and creative patriotism at the constitutional level. According to him, there is every reason to call the new draft Constitution a fundamentally updated, comprehensively analyzed, high-quality and advanced document. It takes into account the best international practices, and fully protects human rights and national interests.
The Head of State also noted the historical significance of the current Constitution. He said that the Constitution is at the root of all achievements over the past 30 years, and its adoption is directly related to the work of the first President Nursultan Nazarbayev. However, it should be noted that the document was adopted during the first, difficult period of our country's independence, and that traces of that time remain.
According to Kassym-Jomart Tokayev, today's Kazakhstan is a fundamentally changed state with a high international reputation. The changing global geopolitical and technological situation, as well as reforms within the country, have had a significant impact on national consciousness. Therefore, it is necessary to modernize the values, goals and objectives of the state at the constitutional level in accordance with modern requirements.
Summing up his speech, the President said that the new Constitution is not a set of separate amendments, but a document aimed at fundamentally rebuilding the foundations of the state in a new historical era. In his opinion, the new Constitution will pave the way for Kazakhstan to develop at a new pace and fully realize the potential of each citizen. The final decision on the Constitution will be made in a nationwide referendum.
