Currency Legislation: control for the sake of economic security

The legal framework for currency regulation in the Republic of Kazakhstan is established by the Law of the Republic of Kazakhstan "On currency regulation and currency control" (Law of the RK No. 167-VI, dated July 2, 2018).
Since January 1, 2024, the functions of currency control have been delegated to the National Bank of the Republic of Kazakhstan and the State Revenue Committee of the Ministry of Finance, acting within their respective jurisdictions.
The currency control authorities are responsible for monitoring the fulfillment of obligations under export-import contracts, overseeing the repatriation of foreign exchange earnings, and verifying compliance with registration and reporting procedures for foreign exchange agreements. Liability for violations:
Administrative liability is governed by the Code of the Republic of Kazakhstan on Administrative Offenses (No. 235-V, dated July 5, 2014):
- Article 251: "Failure to comply with repatriation requirements for national and/or foreign currency" establishes liability for the delayed or incomplete receipt of funds resulting from export operations.
- Article 244: "Violation of the procedure for obtaining accounting numbers for currency agreements or foreign bank accounts, and the submission of related information, documents, and reports" provides for liability regarding non-compliance with registration requirements and reporting mandates.
In practice, the most frequent violations include the untimely repatriation of export earnings, the failure to obtain an accounting number for a currency agreement, and violation of deadlines for submitting mandatory summaries.
Applying administrative measures is designed to ensure the transparency of cross-border transactions, strengthen financial discipline, and protect the state's economic interests.

Currency control authorities primarily focus on preventing offenses by conducting \ outreach and providing explanatory guidance to participants of foreign economic activity. Compliance with currency legislation is a fundamental responsibility for all international trade participants and serves as a critical component of the economic security of the Republic of Kazakhstan.
