The Regional Communications Service held a briefing "Out-of-court bankruptcy."
During the briefing, the head of the department for work with insolvent debtors of the Department of State Revenues Tobyl Demesinov said,
One of the envisaged procedures is out-of-court bankruptcy.
To date, the out-of-court bankruptcy procedure can be applied exclusively for debts to banks, microfinance organizations and collection agencies that do not exceed 1,600 times the monthly settlement indicator, which this year is 6,920,000 tenge.
To apply for out-of-court bankruptcy, the following conditions must be met in aggregate:
- lack of ownership of property, including common property;
- no repayment of debt within 12 months on the date of filing such an application;
Repayment is considered to be a payment in the amount exceeding the one-time amount of the monthly calculation indicator valid on the date of payment.
- carrying out a debt settlement procedure against the debtor;
Measures to settle and/or recover debts specified in this sub-clause shall be carried out within a period not exceeding twelve months from the date of occurrence of overdue debts;
Requirements for debt settlement do not apply to bank loan agreements and (or) microcredit agreements concluded before January 1, 2025.
- Non-application of the procedure of extrajudicial or judicial bankruptcy for seven years on the date of application.
The law also provides for special conditions:
- the requirement of no payments within 12 months does not apply if the citizen received targeted social assistance within the last 6 months;
- if the term of default exceeds 5 years, the above conditions shall not apply.

through the e-government portal (eGov.kz),
via the eGov Mobile app.
The provision by the debtor of any other documents other than the application is not provided for by law.
All applications are sent to the Tazalau information system, where they are automatically checked for compliance with the established criteria.
To date, the state revenue bodies of the region have received 16,834 applications for the use of extrajudicial bankruptcy, of which.
- bankruptcy procedure is carried out on 1126 applications of citizens (6 months are carried out);
- 2496 debtors with a total amount of accounts payable over 4,258.2 million tenge were declared bankrupt and the bankruptcy procedure for them was completed;
- 12,085 applications for bankruptcy proceedings were refused (71%).
The main reasons for refusals are the availability of repayment within 12 months, the availability of property.
The largest number of applications for out-of-court bankruptcy was received in:
- Kokshetau PDA - 4255 (25%),
- UGD in Tselinograd district - 1864 (11%),
- UGD in Akkol district - 1763 (10%).
It should be borne in mind that declaring bankrupt entails certain consequences:
- ban on obtaining loans from banks and MFIs for a period of 5 years;
- repeated bankruptcy is possible only after 7 years;
- for 3 years, the acquisition of bankrupt property is monitored.
Separately, I will dwell on the changes that came into force on March 19, 2026.
First, pawnshops are excluded from the number of creditors when applying extrajudicial bankruptcy. Accordingly, debts to pawnshops are not taken into account.
Secondly, if the amount of debt does not exceed 1600 MCI and the term of default exceeds 5 years, the procedure is carried out in an abbreviated manner - within 1 month.
These changes are aimed at simplifying the procedure and increasing its accessibility for citizens.
