At the site of the VIII Civic Forum discussed the tasks on consumer protection, improving business regulation and the transfer of government functions in a competitive environment

The meeting was attended by representatives of public associations of the NGO “Organization of Veterans”, “Consumer Rights Association”, the ALE “Civil Alliance of Kazakhstan”, etc.
At the beginning of the conversation, Asan Darbayev noted the importance of an open and effective dialogue between the public sector and civil institutions.
Representatives of NGOs made proposals for a qualitative improvement in the interaction of state bodies and civil society institutions, the development of the non-governmental sector, as well as possible areas of mutual cooperation.
“The legal norms in the legislation on consumer protection should create favorable conditions for the development of public associations of consumers. Here we are making enough efforts to maximize the potential of public associations, ”noted A. Darbayev.
According to Darbayev, institutional strengthening of public organizations for the protection of consumer rights, expanding the capacity of NGOs to conduct quality and safety examinations of goods and services will be the main focus of work in the near future.
Representatives of the Ministry expressed hope for the fruitful cooperation of the state body with the non-governmental sector in the framework of the creation of the Consumer Protection Association, which will monitor (control) the observance of consumer rights, participate in the direct protection of their rights in the pre-trial and court proceedings, publish the results of independent examinations and assessments in relation to various segments of the consumer market and all sorts of unscrupulous behavioral practices; equal knowledge of citizens.
Director of the Department of Entrepreneurship Development Aslanbek Dzhakupov spoke about the main aspects of the ongoing reform in the system of state control and supervision:
“Our work was started with an analysis of the state of control and supervisory activity in general. The results of this analysis showed that, thanks to systemic reforms, today, according to legal statistics, the total number of inspections against business entities since 2010 has decreased by more than 4 times.
Today, one of the significant business burdens is the time for conducting inspections, since the inspector spends a long time with an entrepreneur with an inspection. Therefore, the law reduced the time for conducting inspections in a special order from 30 to 15 working days, and unscheduled inspections from 30 to 10 working days.
According to the speaker, the implemented institute of preventive control will allow building partnership relations with business entities and will fundamentally change the mentality and behavior of inspectors.
The meeting participants expressed confidence that the measures taken by the state body will ensure the protection of the rights and interests of entrepreneurs when interacting with the subjects of natural monopolies and the quasi-state sector, as well as ensure the participation of business in regulating business activities and protecting their interests.
The systemic work on the transfer of the functions of state bodies to the competitive environment and to self-regulating organizations was discussed by the deputy director of the Department of Public Administration Development Askarbek Yertaev.
“From 2000 to 2016, 28 functions of state bodies were transferred to the competitive environment. For example, veterinary medical and preventive activities, assigning the status to a breeding animal, the distribution of the quota of withdrawal of fish resources and other aquatic animals, certification of goods and services, the organization of technical inspection, the competition for the Prize of the President of the Republic of Kazakhstan "Altyn Sapa" and the republican competition-exhibition The best product of Kazakhstan "and others."
To improve the efficiency of work on the transfer of functions of state bodies, a corresponding draft law has been developed.
“During the formation of the draft law, the best practices of OECD countries were studied. For example, in the United States, there is a law on the inventory of functions of federal authorities, which requires federal executive bodies to determine annually those functions that are not by nature unambiguously state-owned and can be transferred to private companies, ”said Yertayev.
According to Yertayev, the implementation of this bill will allow to build a legal basis for the system transfer of functions unusual for the state to the competitive environment, increase citizen participation in the decision-making process, including through the development of self-regulation, improve the quality of services provided to citizens, and also bring cooperation to a new level. government and business, ready to take responsibility for the qualitative performance of obligations to society.
Following the meeting, the parties noted the need to establish closer cooperation, as well as to identify new mechanisms for interaction.
