Protection of economic security: prohibitions and restrictions on foreign trade operations 29.05.2025
The legislation of the Republic of Kazakhstan stipulates that bans and restrictions may be imposed on certain goods when they are transported across the State border as a measure of non-tariff regulation of foreign trade. Such bans and restrictions are imposed by the relevant government agencies and are aimed at protecting the domestic market, ensuring safety, supporting domestic producers, and preserving irreplaceable natural resources. Control over the observance of prohibitions and restrictions on the movement of goods across the State Border is entrusted to the state revenue authorities. Currently, the Republic of Kazakhstan has temporary bans on the export of a number of goods, such as petroleum products, liquefied gas, scrap ferrous and non-ferrous metals, timber, chicken eggs, etc. At the same time, unscrupulous participants in foreign economic activity are attempting to export such goods, bypassing existing restrictions. In 2024 alone, the state revenue authorities at the State Border prevented more than 2,000 attempts to illegally export prohibited goods, mainly petroleum products. 378 such attempts have already been stopped this year. For example, in February 2025, an attempt to export 34 wagons with petroleum products was stopped at the border with the Kyrgyz Republic together with the Border Guard Service. In March 2025, 10 cargo vehicles with metal pipes were detained on the border with Uzbekistan. Such facts pose a threat to the economic security of the state, leading to risks of shortage of goods necessary for the domestic market of the country. In turn, for violating the current prohibitions and restrictions on the movement of goods across the customs border of the EAEU, administrative liability is provided for from 15 to 50 monthly calculation indices with confiscation of goods and (or) vehicles by court decision. In addition, in some cases, criminal liability is provided in the form of restriction or imprisonment for up to one year. It should be noted that other EAEU countries also impose similar restrictions. For example, the Russian Federation temporarily restricted the export of commercial gasoline, the Kyrgyz Republic banned the import of certain types of agricultural products, building materials, etc. In this regard, the State Revenue Committee urges all participants in foreign economic activity to strictly observe the established prohibitions and restrictions when moving goods across the State border. International IOTA Forum: Implementation of Measures to Counter Base Erosion and Profit Shifting 29.05.2025
               From May 21 to 22, 2025, employees of the State Revenue Committee took part online in the international forum of the Intra-European Organization of Tax Administrations (IOTA), dedicated to the implementation of measures to counteract the erosion of the tax base and profit shifting (BEPS).       The main purpose of the forum was to facilitate the exchange of experience, positive and negative practices in the field of countering BEPS, as well as the creation and maintenance of a network of officials specializing in the practical implementation of BEPS measures.      During the workshop, key aspects of the implementation of the BEPS Action Plan under the 2024-2025 mandate were discussed. The participants exchanged experiences on the practical application of legislation related to the Second component of the solution and discussed the resulting challenges for tax administrations. Special attention was paid to the issues of country reporting (CbC) and its relation to the Rules of the Global Fight against Base Erosion (GloBE), procedures for mutual agreements in complex tax disputes, as well as business restructuring, including the transfer of intangible assets.       Among the speakers of the event were representatives of the tax administrations of the IOTA member countries, as well as invited experts with international experience in tax policy and practical implementation to counteract the erosion of the tax base and profit shifting.       At the end of the workshop, the participants emphasized the importance of such events to strengthen international dialogue and exchange best practices.
