Requirements for making payments to the budget 12.04.2025
Since January 13, 2025, Kazakhstan has implemented the international standard for the ISO 20022 payment message format, implemented by the National Bank of the Republic of Kazakhstan. The transition covers the country's payment systems, information systems of second-tier banks and other participants in the payment market. In this regard, changes have been made to the Rules for making non-cash payments and money transfers in the territory of the Republic of Kazakhstan (approved by Resolution No. 208 of the Board of the National Bank of the Republic of Kazakhstan dated 08/31/2016), and a new form of payment order for the payment of budget payments has been approved. The key change is the new "Actual payer" column. For the correct transfer of taxes and payments to the budget, we pay attention to the order in which it is filled out.: Legal entities that make payments for branches and structural divisions must indicate the name and BIN of the relevant division. Bailiffs transferring funds for debtors' obligations must indicate the debtor's full name and IIN. Important! Incorrect indication of the data in the "Actual payer" column may lead to incorrect transfer of funds and the formation of arrears. Recommendations: Strictly observe the requirements of the National Bank when filling out payment orders. If you have any questions, please contact the second–tier service banks. We urge taxpayers to be attentive and responsible when processing payment documents.Source : https://www.gov.kz/memleket/entities/kgd-pavlodar/press/news/details/974228?lang=kk

Constitutional Court: The Citizen Did Not Properly Exercise the Right to Judicial Protection 12.04.2025
Теlegram CС - https://t.me/consot_kz   The Constitutional Court received a petition requesting a review of the constitutionality of Part 2 of Article 102 and subparagraph 11) of Part 2 of Article 138 of the Administrative Procedure and Process Code. These provisions establish the jurisdiction over administrative cases and provide grounds for the court to return a statement of claim. The first-instance court returned the claimant’s statement of claim against a state institution. The appellate and cassation courts upheld this decision. The claimant believes that the return of the claim based on the aforementioned provisions deprived him of the right to judicial protection, as the courts failed to indicate in their rulings which court he should turn to in order to protect his rights and freedoms. The Constitutional Court drew the claimant’s attention to the fact that his claims could be pursued by filing a lawsuit in a court seeking enforcement or the performance of an action in accordance with Articles 133 and 134 of the Code.Following a preliminary review, the Constitutional Court found the applicant’s arguments insufficient to warrant a constitutional review of the contested provisions. Source : https://www.gov.kz/memleket/entities/ksrk/press/news/details/974193?lang=kk
