The Constitutional Court will review the constitutionality of the provision on dismissal at the employer's initiative 14.10.2025
Теlegram CС - https://t.me/consot_kz Based on the results of a preliminary review, the Constitutional Court of the Republic of Kazakhstan accepted for constitutional proceedings a citizen's appeal to verify the constitutionality of subparagraph 2) of paragraph 1-1 of Article 52 of the Labor Code of the Republic of Kazakhstan. The contested provision provides for the possibility of terminating an employment contract at the initiative of the employer in the event that an employee of a quasi-public sector organization commits a corruption offense. The applicant, who was previously dismissed from his position as an electric locomotive driver on these grounds, believes that this provision restricts his constitutional rights to freedom of labor and freedom to choose his occupation and profession. In his opinion, the provision is applied broadly, without taking into account the nature of the work performed, and does not differentiate between positions related and unrelated to the performance of managerial functions.Information on the progress and results of the review will be published on the official website and Telegram channel of the Constitutional Court of the Republic of Kazakhstan.Source : https://www.gov.kz/memleket/entities/ksrk/press/news/details/1083324?lang=kk

Kazakhstan: Probation Violator Jailed After Wife Reveals Truth 14.10.2025
Kazakhstan: Probation Violator Jailed After Wife Reveals TruthA brazen violation of probation rules has been recorded in the Shemonaikha district of the East Kazakhstan Region (EKR). A supervised individual, who was on the probation service registry and wearing an electronic monitoring bracelet, has been sent to prison after his wife did not conceal the truth about his movements. The probationer, assigned the electronic monitoring device, apparently believed he could outsmart the system. His plan fell apart after a simple phone call and a subsequent check by the authorities.Initially, a probation service officer used the monitoring system to confirm the convicted person was at his residence. However, during a control call, the offender's brother reportedly claimed the man had gone out to visit friends."At the same time, the mobile application showed the convicted person was home. However, upon arriving at the location, the inspector found that the bracelet was in place, but the supervised individual was not at home," noted Aigerim Nurgazina, a representative of the press service for the Department of the Penal System (DUIS) EKR.During an interview, the violator's wife did not hide the truth. She confessed that her husband had been removing the bracelet himself, and they had gone out together at night to visit friends, and he had also left to spend time with other friends. For this flagrant violation of the conditions of serving his sentence, the convicted person has been transferred to a correctional facility.Furthermore, it was discovered that the electronic bracelet was damaged from attempts to remove it. Consequently, documents have been forwarded to the court regarding the violator's liability to compensate the state for the damage to government property."Probation service staff monitor supervised individuals comprehensively. Attempts to deceive the electronic tracking system and damage the electronic monitoring device lead to the immediate toughening of the sentence and financial responsibility," Aigerim Nurgazina summarized. Source : https://www.gov.kz/memleket/entities/duis-vko/press/news/details/1083401?lang=kk
