NEW CONSTITUTION – A NEW QUALITY OF RIGHTS AND OBLIGATIONS 16.02.2026
Part II of the new draft Constitution has been significantly updated and renamed “Fundamental Rights, Freedoms and Duties”. Such a structure will clarify the interrelationship of rights and duties and allow them to be considered as a single legal system. Thus, a comprehensive model is formed in which the rights of a citizen and his responsibility to the state are considered simultaneously. Clarity on citizenship issues According to the draft, dual or multiple citizenship is not allowed. Acquiring citizenship of another state is a basis for terminating citizenship of Kazakhstan. This norm enhances legal clarity and clarifies the legal relationship between a citizen and the state. Guarantee of state responsibility It is established that everyone has the right to recover from the state the damage caused by the unlawful actions of state bodies or their officials. This provision strengthens the mechanisms for protecting the rights of citizens by clarifying the responsibility of state authorities at the constitutional level. Constitutional guarantees of fundamental rights The right to life is defined as an inalienable and inalienable right. It is clearly stated that no one has the right to take human life arbitrarily. Guarantees of personal freedom and inviolability will be strengthened. The presumption of innocence will be enshrined in the section on fundamental rights and defined as a mandatory constitutional standard for all state bodies. Privacy and digital security The norms of inviolability of privacy will be expanded. The protection of personal data, bank secrecy, correspondence and telephone conversations, including digital communications, will be enshrined at the constitutional level. Labor rights will be brought into line with international standards, and the state's duty to create conditions for employment will be clarified. It establishes that housing is inviolable and can only be deprived of it based on a court decision. This is aimed at increasing the level of social protection of citizens. Marriage is constitutionally recognized as a voluntary and equal union of a man and a woman, registered by the state in accordance with the law. The secular nature of the education system is clearly defined, and the secular principle of the state is strengthened. Environmental responsibility and political demands The duty of citizens to preserve nature and take care of natural resources is enshrined at the constitutional level. This is aimed at establishing environmental responsibility as a public value. The requirements for the right to vote will also be clarified: persons who have been declared incompetent, have an outstanding criminal record, or have committed corruption offenses cannot be elected. This will contribute to increasing the transparency and credibility of the political system. Changes aimed at strengthening the rule of law The updates in Part II not only clarify human rights, but also strengthen the guarantees for their protection and define the duties of every citizen to society. The proposed norms are a systematic step aimed at deepening the principles of the rule of law and ensuring social stability.
NEW CONSTITUTION: CHANGES IN THE INSTITUTE OF THE PRESIDENT AND BALANCING MECHANISMS 16.02.2026
Part III of the new draft Constitution includes a number of important changes that define the powers of the President and his institution. The institution of the Vice President will be introduced The project envisages the introduction of the Vice-President institution. The Vice-President is appointed by the President with the consent of the Kurultai. He/She is responsible for representing the country at the international level and ensuring coordination between state bodies. In addition, the Vice-President is required not to be a member of a political party. This requirement is aimed at ensuring political neutrality and strengthening the principles of fair competition. Procedure for resignation and early termination of authority The voluntary resignation of the President is processed through the Constitutional Court. In the event of premature termination of the term of office, the succession of powers is clearly regulated: first, the powers are transferred to the Vice-President, and if he is unable to do so, to the Chairman of the Constituent Assembly, and then to the Prime Minister. Early elections are held within two months after the decision of the Constituent Assembly. The document was registered with the Ministry of Justice on February 13, 2026 (No. 37975). This measure was taken in order to reduce the financial burden on entrepreneurs and make it possible to settle debts without additional sanctions. If the entrepreneur fully pays off the amount of arrears (principal tax debt) that was due on January 1, 2026, in the period from January 1 to March 31, 2026, then: - all accrued interest (including interest accrued before the day of full payment) will be written off; - fines for those taxes and mandatory payments for which the debt has been repaid will be written off; - fines for turnover committed before January 1, 2026 during the period of non-registration for VAT (in the absence of enforcement measures as of January 1, 2026) may also be written off. It strengthens the rights of citizens in their relations with state bodies, including dishonest officials," said Azat Peruashev. At the same time, the Majilis emphasized that much depends on the citizens themselves, and how prepared they are to protect their constitutional rights is important. "As for security issues, it should be noted that they are not intended to be considered separately. The Constitution clearly establishes the territorial integrity and indivisibility of the country. The structure of state power remains unchanged. At the same time, the adoption of appropriate constitutional laws for cities of rapid development is envisaged. All decisions are made within the existing legal framework and under the control of state bodies. eGov Mobile has introduced a new service enabling the provision of social assistance to eligible categories of vulnerable citizens 15.02.2026
Citizens facing difficult life circumstances can now apply for social assistance through the eGov Mobile application. Previously available exclusively through the eGov.kz portal, the service can now be accessed and applications submitted directly via a smartphone.Social assistance refers to financial benefits or material support provided by local executive authorities to designated categories of citizens who find themselves in difficult life circumstances. The shift to a mobile format enhances accessibility, making it easier and more convenient for citizens to receive this support. Applications may be submitted at any time and from any location, with the entire process taking only a few minutes to complete.Social assistance granted under decisions of local representative bodies (maslikhats) is provided to citizens requiring additional support, including individuals with socially significant illnesses, elderly persons unable to care for themselves, individuals without parental care, and low-income families."The application submission process is highly automated. When submitting an application, part of the required data is automatically retrieved from government information systems, simplifying the process and reducing the likelihood of errors. As practice has shown, more than 7.000 applications were submitted through the eGov.kz portal in 2025 alone” noted Daulet Bekmanov, Chairman of the Board, NITEC JSC.To apply for the service, users need to:log in to the eGov Mobile application and go to the "eGov Public Services" – "Special services" section;select the service “Provision of Social Assistance to Specific Categories of Vulnerable Citizens under Decisions of Local Representative Bodies” and complete all the required fields;sign the service using one of the available signing methods;review the notification on the application processing status in the “Service History” section.The service delivery result is a notification of the approval of social assistance or a reasoned refusal.Following submission, the application is reviewed by the authorized body. Volunteerism becomes a strategic direction: Amendments to the draft Constitution have been made 15.02.2026
For the first time, the draft of the new Constitution of Kazakhstan proposes to establish a norm of state support for volunteerism. The relevant amendments were discussed by deputies of the Mazhilis of the Parliament of the Republic of Kazakhstan during the online marathon "Referendum-2026". According to Majilis deputy Vera Kim, the constitutionalization of volunteerism is not only a recognition of its importance, but also a guarantee of state support for the long-term development of the volunteer movement. "Thus, by raising the volunteer movement to the level of the Constitution, we will create conditions for every citizen to feel involved in the development of the state. This will contribute to the formation of a more sustainable development of society," added deputy Islam Sunkar. In turn, MP Azhar Sagandykova noted that volunteering is not limited to young people.
