A club for convicted mothers was opened in the Abai region. More than 300 women convicted of medium, serious and especially serious crimes are serving their sentences in the women's colony of the Abai region. Procedure for Customs Operations Related to Refusal to Release Goods 14.10.2025
Modern processes of foreign economic activity in the Republic of Kazakhstan require strict compliance with customs procedures that ensure the legality and security of goods crossing the border. One of the instruments of customs control is the possibility of refusal to release goods. This measure is applied in cases of violations of legislation and is regulated by the provisions of the EAEU Customs Code and national legislation.The legal regulation is based on:- The Customs Code of the Eurasian Economic Union (EAEU CC) of April 11, 2017;- The Code of the Republic of Kazakhstan “On Customs Regulation in the Republic of Kazakhstan” of December 26, 2017 (hereinafter – the Code);- Decision of the Board of the Eurasian Economic Commission of December 19, 2017 No. 188 “On Certain Issues Related to the Release of Goods.”According to Article 201 of the Code, the grounds for refusal to release goods are as follows:1) failure to comply with the conditions under which the customs authority releases goods;2) failure to comply with the customs authority’s requirements to amend (supplement) information declared in the customs declaration;3) if the goods do not arrive within thirty calendar days from the day following the registration of the preliminary customs declaration;4) non-compliance with the specifics of periodic customs declaration, and/or the presence of an unfulfilled obligation by the declarant to pay customs duties, special, anti-dumping, countervailing duties, interest, and/or penalties;5) failure to present goods upon the request of the customs authority within the time limits for release of goods;6) failure to renew the release period of goods in cases of suspension due to non-compliance with intellectual property rights;7) failure to comply with the customs authority’s requirements to provide requested customs documents;8) classification of goods declared in a passenger customs declaration as not intended for personal use;9) detection of violations by customs authorities during customs control of goods of the customs legislation of the Eurasian Economic Union and/or the customs and other legislation of the Republic of Kazakhstan, except when:- identified violations not serving as grounds for initiating administrative or criminal proceedings are remedied; - identified violations are remedied and the declared goods are not seized and not subject to arrest in accordance with the laws of the Republic of Kazakhstan;- bankruptcy proceedings are initiated against the declarant.The refusal to release goods is formalized using the customs authority’s information system or by affixing the appropriate marks on the paper customs declaration. The refusal document must specify all reasons that served as the basis for such refusal.Customs operations related to refusal to release goods are carried out by the customs authority before the expiration of the release period for goods.The procedure of refusal to release goods is an important element of the customs administration system of the Republic of Kazakhstan. It is aimed at ensuring the legality of foreign economic operations and protecting the country’s economic security. An attempt to transfer narcotic substances was stopped in one of the medium-security penal colonies in Semey. During a hidden patrol, employees of the institution No. 20 DUIS in the Abai region detained two residents of Semey, aged 34 and 29 years. The men tried to throw a package wrapped in duct tape over the main fence. Inside there was a green substance of plant origin with a specific odor. The examination confirmed that the seized substance is dried marijuana weighing about 60 grams. The new Tax Code of the Republic of Kazakhstan cancels the withholding of individual income tax from pension payments from the UAPF for residents of the Republic of Kazakhstan 14.10.2025
Current questions about the UAPF1. What portion of a pension is currently taxed in Kazakhstan and what portion is not?In Kazakhstan, pension benefits from the state budget are tax-exempt, while benefits from the Unified Accumulative Pension Fund (UAPF) are taxable. According to the current Tax Code, pension benefits from the UAPF are considered income subject to individual income tax (IIT) at a rate of 10% at source. This means that pension contributions are transferred to individual pension savings accounts before tax. IIT is withheld upon payment. IIT is withheld collectively from all types of pension benefits, including compulsory pension contributions (CPC), compulsory occupational pension contributions (COPC), and voluntary pension contributions (VPC). Adjustments and tax deductions are also taken into account.However, this situation will only last until the end of 2025. As a reminder, the new Tax Code will come into effect on January 1, 2026, and, according to it, IIT will not be withheld from pension benefit payments from the UAPF. 2. What changes have been made to the new Tax Code of the Republic of Kazakhstan regarding individual income tax (IIT) on pension benefits?According to the new Tax Code of the Republic of Kazakhstan, from 01.01.2026, individual income tax (IIT) will not be withheld from all types of pension payments, as well as from lump-sum pension benefit payments (LSPBP) for housing and/or medical treatment, except for cases when the recipient is not a resident of the Republic of Kazakhstan. The changes also include the cancellation from January 1, 2026 of accrued obligations to pay IIT from LSPBP for housing/treatment, deferred until pension payments are received according to the schedule. 3. Will the IIT withheld before January 1, 2026 be refunded? The provisions of the new Tax Code do not provide for the return of previously withheld IIT.Let us clarify that according to the current Tax Code, when using lump-sum pension benefit payments for housing/treatment, IIT is withheld. At the same time, there are two ways to withhold it at the recipient's choice: immediately upon receipt of the LSPBP or with a deferment until retirement. In connection with the introduction of the new Tax Code from 01.01.2026, if the contributor pays IIT earlier, it will not be returned, and the obligations for the deferred IIT will be written off.Let us note that until December 31, 2025 inclusive, the calculation, withholding and payment of IIT from pension payments and EPO from UAPF will be carried out in the current mode 4. If the beneficiary has reached retirement age and is paying IIT, will the IIT deduction continue from 1 January 2026?The provisions of the new Tax Code provide for the exemption from January 1, 2026, of income in the form of pension payments, lump sum pension benefit payments from UAPF from individual income tax, with the exception of pension benefit payments from UAPF made to non-residents of the Republic of Kazakhstan. 5. How will the rules on tax deductions for voluntary pension contributions change?The changes include the abolition of tax deductions on voluntary pension contributions made in one's own favor from January 1, 2026. However, like other types of payments from the UAPF, pension benefits from the VPC will be exempt from IIT.At the same time, the rule will remain that voluntary pension contributions transferred by a tax agent to the UAPF in favor of an employee are not an individual's income (and therefore are not subject to IIT), and for the employer, such expenses are deductible when calculating corporate income tax. The project is being implemented within the framework of the National Development Plan until 2029 and is fully funded by NCE «Atameken».For business, the DCB provides access to data on state support measures, regional priorities and their specialization, the implementation of investment projects, mandatory requirements by type of activity, as well as on product demand. Such information will help entrepreneurs plan their development, find new niches, and build effective strategies.For the state, the digital card will become a tool for monitoring priority industries and the implementation of investment projects, a system for analyzing supply and demand, a source for an objective assessment of the business climate and the effectiveness of state support, as well as a means of controlling the counter-obligations of business.Today, small and medium-sized businesses provide about 40% of GDP and almost half of the country's employment, and the DCB should contribute to the further growth of these indicators through accurate analytics and systemic interaction between the state and entrepreneurs.Currently, NCE «Atameken», together with state bodies, is working on the implementation of the Digital Card of Business on the QazTech platform.
