Bankruptcy of Legal Entities: Another Step Toward Greater Transparency of the Procedure 05.07.2026
 Since the beginning of the current year, a number of changes have been introduced in the field of bankruptcy of individuals and legal entities.On January 16, 2026, amendments were adopted to the Laws of the Republic of Kazakhstan “On Restoring the Solvency and Bankruptcy of Citizens of the Republic of Kazakhstan” and “On Rehabilitation and Bankruptcy.”It should be noted that the legal framework governing the bankruptcy of legal entities has not undergone significant changes in recent years. At the same time, the evolving nature of legal relations in this area has demonstrated the need for further measures aimed at improving the effectiveness of bankruptcy and rehabilitation procedures. To facilitate implementation and ensure convenience for participants, the amendments are being introduced in stages.Accordingly, amendments entering into force on March 19, 2026, provide for:granting bankruptcy administrators additional powers, including with respect to the calculation of additional remuneration and filing applications with the court to invalidate the re-registration of a legal entity;introducing a mechanism for the removal of a temporary administrator;expanding the methods of notifying creditors about meetings of the creditors’ assembly and creditors’ committee;establishing a waiting period before a debtor may reapply for bankruptcy following a previous refusal by the court;preventing the application of rehabilitation procedures where there are no creditors other than those with claims for taxes and other mandatory payments;determining the quorum requirements and decision-making authority of creditors’ meetings in cases involving the direct sale of a bankrupt debtor’s property.These amendments are expected to reduce attempts to misuse rehabilitation and bankruptcy procedures and to increase their transparency and effectiveness.At the same time, legislative work in this area continues. Amendments to the Law “On Rehabilitation and Bankruptcy” are currently under consideration by the Mazhilis of the Parliament of the Republic of Kazakhstan. Digital transformation of bankruptcy and rehabilitation procedures (ISNA Information System): from paper cases to open data 05.07.2026
Over the past three years, the National Institute of Bankruptcy has undergone a massive digital transformation.      Previously, all processes within the framework of rehabilitation and bankruptcy procedures were carried out exclusively on paper, but today a significant part of the work has been transferred to electronic format in the Integrated Tax Administration Information System (IAS).      More than 6 thousand cases have been digitized in ISNA, over 30 thousand documents have been accepted and processed electronically, which has significantly accelerated the review processes and increased their transparency.       An important step was the development of digital services for external users. On the Committee's new portal (portal.kgd.gov.kz ) implemented open API services that provide access to:     - lists of debtors in respect of whom court decisions on declaring them bankrupt, applying rehabilitation procedures, or liquidating them without initiating bankruptcy proceedings have entered into legal force;    - lists of individual entrepreneurs and legal entities in respect of which court rulings on termination of the rehabilitation procedure have entered into force;   - announcements on the initiation of bankruptcy proceedings and the procedure for creditors to file claims;   - announcements on the initiation of rehabilitation proceedings and the procedure for creditors to file claims;   - declarations on declaring the debtor bankrupt and its liquidation with the initiation of bankruptcy proceedings;   - declarations of liquidation of the debtor without initiation of bankruptcy proceedings;  - notifications on holding a creditors' meeting in the bankruptcy procedure;  - notifications of the creditors' meeting in the rehabilitation procedure;   -the register of creditors' claims in bankruptcy and rehabilitation procedures.       To connect to the API services, click on the link: https://portal.kgd.gov.kz/ru/pages/api-services .      It should be noted that the transition to electronic document management not only reduces the administrative burden, but also minimizes the risks of errors related to the human factor.      In turn, the introduction of open APIs helps to increase the transparency of procedures and the development of a digital ecosystem around the institution of bankruptcy.     In addition, digitization of debtors' files and automation of the interaction of participants in bankruptcy procedures in the future will automate the administration and detection of signs of intentional bankruptcy.      Currently, this task is a priority for us.      Thus, in a short period of time, the bankruptcy institute has moved from a paper bureaucracy to modern digital solutions that meet the requirements of the time and the expectations of users – administrators, creditors and other participants in the procedures.Source : https://www.gov.kz/memleket/entities/minfin/press/news/details/1243165?lang=ru

Intentional bankruptcy 05.07.2026
Recently, cases of intentional bankruptcy have become increasingly common, where companies, unable to meet their obligations or deliberately seeking to evade them, are declared bankrupt through court proceedings. However, such actions no longer go unpunished.The concept of intentional bankruptcy is established by the Law of the Republic of Kazakhstan “On Rehabilitation and Bankruptcy,” according to which it refers to deliberate actions of a founder, official, or individual entrepreneur aimed at evading obligations to creditors through the disposal or concealment of property.Indicators of intentional bankruptcy may include entering into knowingly disadvantageous or fictitious transactions, withdrawal of assets, refusal to collect receivables, concealment or transfer of property, artificial increase of liabilities, deliberate destruction of management and accounting systems, and other unlawful actions.The legislation of the Republic of Kazakhstan, including the above-mentioned Law, the Code of Administrative Offenses, and the Criminal Code, provides for personal liability of founders and company officials.Where bankruptcy is determined to have been intentional, the controlling person may be held subsidiarily liable by court order. In such cases, the company’s debts may be recovered from the personal assets of the responsible individual.Moreover, subsidiary liability may be imposed even after the completion of bankruptcy proceedings if the responsible person is found guilty as a result of administrative or criminal investigations.During 2024–2025, following analyses of all debtors undergoing bankruptcy proceedings, 120 administrative cases and more than 44 criminal cases were initiated based on indications of intentional bankruptcy.The state revenue authorities plan to further enhance the detection of intentional bankruptcy through the use of automated analytical tools capable of identifying suspicious transactions, links between companies, and debtor behavior patterns. To this end, active work has begun on the automation of rehabilitation and bankruptcy procedures.For example, in 2024, a former director of a company in the Zhambyl Region was convicted by a court of intentional bankruptcy. In 2025, the court ordered the individual to compensate creditors more than KZT 45 million for assets withdrawn from the company’s bank accounts prior to its declaration of bankruptcy.Such cases are not isolated. In 2025 alone, courts issued more than 12 similar decisions against responsible individuals. With the introduction of automated mechanisms for detecting unlawful debtor activities, the state revenue authorities expect to improve the effectiveness of materials referred to law enforcement agencies through stronger analytical justification and a more systematic evidentiary framework, which will consequently increase the number of claims filed with the courts.Thus, bankruptcy is no longer a means for unscrupulous entrepreneurs to evade responsibility. Instead, it is becoming an effective mechanism for restoring fairness, aimed at maximizing creditor recovery through holding responsible persons personally liable. Today, Regional Akim Murat Ergeshbayev visited several sites in the city. A two-lane pedestrian and bicycle path, 2,756 meters long, with an asphalt concrete surface will be built. Additionally, the slope of the protective dam, 2,928 meters long, will be reinforced. Regional Akim Murat Ergeshbayev held an in-person citizen reception on a first-come, first-served basis. Twelve people registered for the reception today, two of whom joined online.Most attendees raised issues of social support, housing, street paving, and employment.A resident of the village of Sekseul in the Aral District spoke about the paving of Aktan Batyr and Tazhibaev Streets. Design documentation for these streets is scheduled for 2028. As part of the "Auyl – El Besigi" program, medium-term repairs were completed on the Akorda cul-de-sac in the village of Sekseul in 2023. Now, repairs to the section of the cul-de-sac leading to the kindergarten are scheduled for the near future.The completion of residential buildings built by the "Bazis-A" institution for railway workers was also discussed at the reception. Together with the city and district akimats, ensure daily improvement, landscaping of station territories, and sanitary cleanliness, – said Murat Nalkhozhauly.There are 1051 kilometers of railway tracks passing through the region's territory. Capital repairs have begun on 83.4 kilometers of them. To date, 50.4 kilometers have been repaired, the remaining 33 kilometers will be completed by the end of the year. At the Sekseul station, 18.7 kilometers of railway are being built and 77 sets of turnouts are being installed.From the Kyzylorda region, 15 pairs of passenger trains operate, and from the regional center to the cities of Astana, Petropavlovsk, Pavlodar, Kokshetau, Semey, Turkistan – 6 pairs.Two years ago, a major overhaul of the railway station in the city of Kyzylorda was carried out and the adjacent territory was improved. The working trip of the regional akim Murat Ergeshbayev and the secretary of the regional maslikhat Murat Tleumbetov to the Zhanakorgan district continued with an inspection of the sown areas of the "Amir" peasant farm in the village of Sunakata. Also, during the trip, the head of the region assessed the progress of research work at the "Syganaq" ancient settlement.On average, the farm produces 200 tons of rice and 400 tons of vegetable and melon products per year. The products are supplied to the domestic markets of the Kyzylorda and Turkestan regions. It is equipped with modern agricultural technologies and machinery. In particular, a "Belarus 1221" tractor, a "Class" combine harvester, KhTZ machinery, loaders, laser levelers, KamAZ trucks, and agricultural drones are used. This allows for the digitalization of crop production and increases production efficiency.This year in the region, grain crops were sown on 89.7 thousand hectares, oilseeds — on 6.1 thousand hectares, fodder crops — on 73.2 thousand hectares, potatoes, vegetables, and melons — on 16.8 thousand hectares.In accordance with the instruction of the Head of State, the area under rice has been reduced by 10.9 thousand hectares and amounts to 70 thousand hectares. This step is aimed at the efficient use of water resources and the diversification of the crop structure.Agricultural producers have carried out a complete repair of the existing 3975 units of machinery. The total volume of required mineral fertilizers is 65.6 thousand tons, of which 11 thousand tons are provided by domestic production.The next site visited by the head of the region was the medieval settlement of Syganaq — one of the most important archaeological sites in our country. A historical city that was the capital of the Kipchak Khanate, later — the Ak Orda and the Kazakh Khanate. It is included in the list of significant historical monuments proposed for inclusion in the UNESCO World Heritage List.Currently, traces of ancient fortress walls, remains of structures that have turned into hills, as well as objects identified during archaeological excavations are preserved here. During a working trip to Zhanakorgan district, Akim of the region Murat Ergeshbayev familiarized himself with the new annex building constructed next to the central district hospital.The construction, aimed at improving the quality of medical services and expanding access to modern diagnostic services for residents, was carried out by the company "Daneker Qurylys Companiasy". 792 million tenge was allocated for it.The total area is 1,212.06 sq. m. It is a two-story building with a basement, designed for 9 beds.A modern magnetic resonance imaging (MRI) machine will be installed.The new building will increase the district residents' access to high-tech diagnostic services and expand opportunities for early disease detection and the provision of quality medical care.Zhanakorgan Central District Hospital is designed for 245 beds. The total building volume is 5,852.4 square meters. It is a three-story building consisting of five blocks.It is equipped with modern medical equipment. It operates an emergency department, surgery, therapy, maternity and gynecology departments, a laboratory, neurorehabilitation, infectious diseases, and intensive care units.Furthermore, services are provided for day hospital, radiation therapy, radiology, transfusion medicine, ultrasound examination, ultrasound for pregnant women, and computed tomography.Today, 1,520 employees of the hospital systematically work towards preserving and strengthening the health of the district's residents. Today, during a working trip to the Zhanakorgan district, regional Akim Murat Ergeshbayev and Chairman of the Regional Maslikhat Murat Tleumbetov met with residents of the village of Akzhol and elders of the villages of Zhanaryk, Abdigappar, and Ozgent. The meeting, held at the "Spirituality Center," was attended by the district's active members, and discussed directions for the region's socio-economic development and upcoming tasks. During the meeting, the head of the region emphasized the need to support projects aimed at developing the processing industry, increasing production volumes, attracting investments, and creating new jobs. He also instructed to effectively utilize the district's tourism potential and implement specific projects.– The deputy akim of the district overseeing industrial production, the processing industry sector, and the head of the entrepreneurship and industry department need to intensify their work.Since 2023, the rice cultivation area has decreased by 1,147 hectares. I instruct to utilize the opportunities offered by the "Auyl Amanaty" project. There are 175 economic canals in the district; accelerate the work on developing projects for their concreting.It is necessary to effectively use Zhanakorgan's tourism potential and turn it into concrete projects. The natural features of the district, located at the foot of Karatau, its historical sites and sanatoriums, cultural and spiritual values allow for the development of domestic and foreign tourism, – said the head of the region.Over the past four years, about 1,800 new apartments have been commissioned in all districts, of which 254 are in the Zhanakorgan district. Quality deficiencies were fully rectified by the contracting organizations. This year, housing construction is also planned.At the same time, the regional akim instructed the deputy akim of the district overseeing the sector and the head of the construction department to organize preparatory work.The gasification level in the district is 53 percent; today, high-pressure gas pipeline construction is underway in 5 settlements. The district akimat, together with the regional department of energy and housing and communal services, must organize work on the phased connection of villages to natural gas.It is worth noting that a stable development trend persists in the main sectors of the district's economy, with positive results achieved in a number of areas. The total volume of agricultural, forestry, and fishery products increased by 105.6 percent compared to the same period last year. The volume of investments attracted into fixed capital amounted to 25.3 billion tenge.
